WINTER STORAGE CONTRACT 2024
TERMS OF AGREEMENT
- Contract Acceptance: This contract will only be accepted upon approval for storage with the yard manager, receipt of reservation deposit, completed and signed winterizing contract, and authorization along with proof of vessel insurance.
- All mechanical work, including decommissioning and commissioning of all systems, are to be completed by the vessel owner or an approved and insured mechanic.
- All work on the outside of the hull from toe rail down, i.e. washing, scraping & painting the bottom of the hull, are to be completed by Seymour’s Boatyard.
- All shrink wrapping must be completed by Seymour’s Boatyard.
- No independent contractors, brokers, service organizations, or outside individuals will be allowed to perform work without first obtaining permission from Seymour’s Boatyard.
- It is expressly understood and agreed upon that in the event the boat, its contents and/or equipment are lost or damaged through theft, fire, vandalism, or act of God, Seymour’s shall not be liable to the owner for such loss or damage unless such loss or damage results from the direct, active, and gross negligence of Seymour’s, its agents, or employees.
- The tenant agrees to have their boat insured at all times with complete marine hull coverage, including liability, and will provide Seymour’s with evidence of such coverage. Each tenant will be held responsible for damage he/she may cause to other boats in the yard or to the structures or facilities thereof.
- Boat owners must provide their own means of entry to and from their boats, i.e., ladders or platforms, and shall keep same and hold harmless Seymour’s from any and all liability arising from and out of the boat owner’s use of premises to enter, clean, repair, or otherwise perform duties on their boats. The boat owner will also assume all liability for any of his/her agents, servants, or invitees.
- Terms of payment: $500.00 deposit required for reservation, one half of the balance due when hauled, and the other half of the balance due no later than December 31st. Bills must be paid in full as rendered. Interest shall accrue at 1.5% per month after 30 days.
- Winter storage shall end on June 30th 2025. Summer storage rates are imposed between July 1st and September 31st 2025.
- Service work is performed on a “cash when completed” basis. The tenant agrees to pay all costs and expenses incurred by Seymour’s if action is necessary to enforce any obligations owed hereunder. The payment of any sums due and payable by the tenant to Seymour’s for purchases, services rendered, and materials supplied. The tenant agrees that Seymour’s shall have a possessory lien upon said boat, its equipment and motor for the amount of the charges for repairs, labor, materials, supplies, storage space and services provided to haul, launch and store the vessel. The tenant agrees that Seymour’s may haul the vessel, without process of law, if it deems that the most economical and convenient means of holding the vessel, until paid in full in cash or equivalent thereof. The tenant agrees and stipulates that charges arising from service upon the vessel or storage shall in every instance give rise to a maritime lien against the vessel, as well as a New York State lien. It is further agreed that should Seymour’s elect to deliver possession prior to full payment of such charges, Seymour’s shall have a security interest in such boat and the proceeds thereof to secure payment of such unpaid charges, including expenses incurred by Seymour’s in any action to collect unpaid charges not paid when due The tenant and Seymour’s agree and stipulate that Seymour’s shall have the right to regain possession of the vessel, with or without process of law, and to hold it again thereafter until paid in full. No release of possession of the vessel by Seymour’s shall be construed or operate to create a waiver or surrender of any rights or remedies hereunder by Seymour’s.
